DELTA BAG TAG PILOT TERMS OF USE

By checking the box next to Item #8 on the Delta Bag Tag Pilot Program Opt-In Form (Acceptance of Delta Bag Tag Pilot Program Terms of Use), typing your name, physical address, and email address connected to your SkyMiles account, and selecting “Submit”, you are agreeing to these Delta Bag Tag Pilot Program (“Pilot”) Terms of Use. If you do not agree to these Terms of Use, you are not eligible to participate in the Pilot. The Pilot is in a Beta/Proof of Concept (POC) phase only, and Delta is not responsible for errors or glitches in the functionality or lack of functionality of the bag tag provided to you by Delta (the “Bag Tag”). By participating, you agree that Delta or its marketing partners may contact you for, and that you will provide, feedback regarding your Pilot participation experience, including with respect to any issues, concerns, or recommendations you have.

The Pilot will take place over a ninety (90) day period commencing in or about December 2023 (the “Pilot Period”). Delta will notify you of the start date of the Pilot in due course. The Pilot is only available to SkyMiles members ages 18 or older who expect to travel on Delta Air Lines-operated flights within the United States within the Pilot Period (“Eligible Flights”) and expect to check a bag on their Eligible Flights. If you do not expect to meet the eligibility criteria for the Pilot in the prior sentence, you should not participate in the Pilot.

To the extent you elect to travel on Eligible Flights during the Pilot Period and check a bag as part of that travel, you agree to: (i) use your SkyMiles number when booking your Eligible Flight; (ii) use the Bag Tag by either attaching the Bag Tag to the outside of your bag or storing the Bag Tag inside your bag (not available for metal suitcases); (iii) bring your bag (with the Bag Tag) to a SkyMiles Priority or Delta One check-in agent each time you travel on an Eligible Flight to allow Delta to associate your Bag Tag and ticket number and to check it for you; and (iv) track the location of your bag using the “Track My Bag” on FlyDelta mobile application. Please note, standard checked bag fees continue to apply throughout the Pilot Period.

Following the end of the Pilot, you may retain possession of the Bag Tag. You agree not to, and agree not to allow any third party to, (i) sell, transfer, license, sublicense, distribute, rent, lease, or otherwise provide the Bag Tag to any third party, or otherwise commercially exploit the Bag Tag or any of its parts, (ii) decompile, disassemble, or reverse engineer the Bag Tag or any of its parts, (iii) modify, translate or create derivative works based on the Bag Tag, (iv) access or use the Bag Tag in any manner outside of the limitations set forth in these Terms of Use, or (v) remove any language or designation indicating the proprietary rights of Delta or its suppliers or licensors from the Bag Tag.

If you participate in the Pilot, Delta will track your bag by collecting its real time location. For more information about our privacy practices, please review the Delta Privacy Policy. By participating in the Pilot, you acknowledge that you have received notice of and understand these privacy practices and agree to Delta processing your personal data as described in the notice.

Delta reserves the right to discontinue the Pilot at any time. Delta and Delta’s employees shall have no responsibility for any losses or damages incurred as a result of participating in the Pilot. This Pilot shall be governed by the laws of the State of Georgia, excluding any conflict of law provision.
