DraftKings SkyPicks :

1. CONTEST DESCRIPTION AND ENTRY: DraftKings SkyPicks is a free-to-play sports pool contest format operated by DraftKings where participants compete against each other by selecting outcomes in response to a series of pool questions in connection with real-world sporting events ("Pool Set"). DraftKings owns and operates the DraftKings SkyPicks application (the "DraftKings Platform"). DraftKings may offer the SkyPicks contest as a daily and/or monthly prediction pool contests (each daily and/or monthly contest shall be considered a “Contest” under these Official Rules). DK Crown Holdings Inc. (“DraftKings) is the sole “Sponsor” of each Contest and is solely responsible for the administration, maintenance, and prize distribution of a Contest. Delta Air Lines, Inc. (“Delta”) is a Prize (as defined in Section 4 below) provider of a Contest. These “Official Rules” govern your entry into a Contest, and by entering into a Contest, you agree to these Official Rules. Any entrant in a Contest shall be deemed a “Contestant”.

Entry into a Contest is free, and no purchase is necessary. For a daily Contest, Contestants may enter a Contest a maximum of one (1) time per account; additional entries by the same Contestant for a Contest will be disqualified and deemed null and void. Contestants can enter a Contest at any time during any one of the individual daily Contests taking place prior to the applicable Contest closing. To enter a Contest, individuals must officially enter a Contest in the applicable Contest lobby on the DraftKings Platform after logging into their account after also logging on to the Delta Sync Wi-Fi internet service their Delta SkyMiles account. Once a Contestant logs in to their Delta SkyMiles account, the Contestant can click on the DraftKings Platform game tile and register for entry into a SkyPicks Contest on the DraftKings Platform. Contestants must answer all of the applicable Contest’s questions in a Pool Set in order to be properly entered into the applicable Contest.  Failure to answer all questions in the Pool Set will deem an entry invalid, null, and void. Contestants must enter the applicable Contest before the entry period closes for that specific Contest. Contest picks must be submitted before you get to your arrival gate, and you will not be able to submit your picks once your plane gets to the arrival gate. You can edit picks that you have submitted after arriving to your gate so long as the Individual Contest Entry Period has not closed. The Contest details located in the information bubble for such Contest will indicate when the Contest entry period closes.

2. PERIOD:  The Contest series begins on July 28, 2026 and ends when DraftKings no longer operates any further Contest(s) on the DraftKings Platform (the “Contest Period”). For each individual Contest, the Contest will close for new entries, and any picks will be locked, at the start of the first game within the applicable question set in that Contest (“Individual Contest Entry Period”). 

2. ELIGIBILITY:  Each Contest is open to legal residents of the fifty (50) United States and the District of Columbia (“Eligible Jurisdictions”), at least twenty-one (21) years old at time of entry, and the Contestant must (i) be the owner of the DraftKings Platform account under which Contest entry is being made (i.e., no proxy entries allowed); (ii) comply with the DraftKings SkyPicks Terms of Use; (iii) logged on to Delta Sync Wi-Fi internet service through their Delta SkyMiles account; (iv) not be voluntarily or involuntarily excluded (including self-exclusion) from play on DraftKings; (v) not be included on any jurisdiction-wide gaming or daily fantasy sports exclusion list; (vi) not be temporarily or permanently banned from playing on any DraftKings website or mobile application; and (vii) maintain any DraftKings accounts in good standing. Maintaining a DraftKings account in good standing does not require the spending of any funds or entry into any Contests by a user. DraftKings may update, amend, or modify the Eligible Jurisdictions in its sole discretion, for any reason, without notice. A Contest is void where prohibited by law. Each Contest is subject to all applicable federal, state and local laws. Directors, employees, and the immediate family (spouse, parent, sibling, children, grandparent or grandchildren and their respective spouses, regardless of where they reside) and/or household members, whether or not related, of individuals employed by Delta, DraftKings,  and all of their respective parents, subsidiaries, affiliates, directors, officers, employees, advertising and promotional agencies, are ineligible to participate in any Contest. “Pre-Release Data” means pre-release, confidential, or other non-public information unavailable to all other entrants that provides a competitive advantage in a Contest, including information from any daily fantasy sports site or sports governing body (e.g., pre-release injury information). The following persons are also ineligible to participate in any Contest:

(a)   any employee or operator of a daily fantasy site that charges entrance fees or offers prizes, or any Immediate Family Member of such person (“Immediate Family Member” means any domestic partner and relative of the person who resides at the person’s resident, including, without limitation, parents, grandparents, in-laws, children, siblings, and spouses);

(b)   any person who has accessed or has access to Pre-Release Data;

(c)   any employee of a sponsor, consultant, supplier of DraftKings or any other daily fantasy sports contest provider who has access to Pre-Release Data or otherwise receives an advantage in participating in a Contest;

(d)   any employee, operator, or consultant of a sports governing body where such person is prohibited from participating in applicable Contests by that governing body;

(e)   any person who breaches any rules or policies of their employer, any sports governing body, or any professional body of which they are a member, including rules regarding Contest participation or accepting prize money;

(f)    any person prohibited from participating pursuant to a court order; or

(g)   any person who has knowingly received Pre-Release Data or any other non-public information providing a competitive advantage in a Contest from any person prohibited from entering a Contest under these Official Rules.

3. CONTEST OPERATION: For daily Contests, Contestant will use their own skill and knowledge to try to pick the correct outcomes from a series of questions in a Pool Set about a real-world sport event or series of sports events. Contestants will earn points for each correctly selected outcome in response to each Pool Set question. The number of pool questions in a Pool Set required to be answered in each daily Contests may vary by Contest.

For a monthly Contest, Contestants will be automatically entered into the applicable monthly Contest for free based on the calendar month in which a Contestant enters into a daily Contest. For example only, in the event a Contestant enters into a daily Contest on December 2, Contestant will be automatically entered into the December monthly Contest, and Contestants will only be automatically entered into a specific monthly Contest one (1) time. Contestants will earn points for each correctly selected outcome in response to the Pool Set questions for every daily Contest a Contestant participates in during the applicable calendar month. For example purposes only, if a Contestant had 5 correct outcome selections in a December 5 daily Contest and 8 correct outcome selections in a December 27 weekly Contest, such Contestant will have 13 points earned for the December monthly Contest.

Where DraftKings determines there is a change in the participant(s) and/or team(s) for a specific Pool Set in a Contest, DraftKings reserves the right to modify the relevant question in the Pool Set to reflect the new participant(s) and/or team(s) or cancel a Contest or portion of the Contest, as the case may be, as determined by DraftKings.

The Contestant must comply with all terms and conditions of these Official Rules, and winning a prize is contingent upon fulfilling all requirements. The Contestant may be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release at the time of the Contest.  If a Contestant cannot be contacted, is not in compliance with these Official Rules or fails to sign and return the Affidavit of Eligibility and Liability/Publicity Release at the time of the Contest if requested by DraftKings, the Contestant may be disqualified and forfeits the prize.

4. CONTEST WINNERS AND PRIZES:  Each of the Contests shall have its own “Prize” and “Prize Pool”. Please see Contest details for information on the Prize, Prize Pool, Prize pay table. Each Contest will have a tiebreaker question. All Delta Gift Card terms apply and are available at delta.com/giftcards.

For each monthly Contest, such monthly Contest shall have its own Prize Pool. The results of each monthly Contest will be determined by the total points accumulated by a Contestant’s picks in each of the daily Contests in which that Contestant participated in during the applicable month. The monthly Contest lobby will have details for information on the Prize, Prize Pool, and Prize pay table.

Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Contestant will be responsible for all federal, state and local taxes and fees and other costs and expenses associated with Prize receipt and/or use that are not expressly included in the Prize description. No cash or other substitution, assignment or transfer of any Prizes permitted, except by Sponsor, who reserves the right to substitute Prize or Prize component with cash or another Prize of comparable or greater value. Non-cash Prizes are not redeemable for cash.  All Prize details are at Sponsor’s sole discretion.

To the extent that DraftKings offers “live” statistics during gameplay, all “live” statistics and other information provided through the DraftKings Website and related information sources are unofficial. Live sports statistics and their respective components are offered for informational and/or entertainment purposes only and are not used to determine the results of the Contests. 5. PUBLICITY: Except where prohibited, participation in a Contest constitutes Contestant’s consent to Delta, DraftKings, and each of their respective parent, subsidiary and affiliated companies and their designees to use his/her name, likeness, photograph, voice, opinions, biographical information, hometown and state for advertising and promotional purposes, in any manner, in any and all media now or hereafter devised, worldwide in perpetuity, without further payment or consideration, notification or permission. 

6. PRIVACY POLICY:  Personal information provided in connection with a Contest will be used in accordance with the DraftKings; Privacy Policy, which can be viewed at https://myaccount.draftkings.com/documents/privacy-notice and in accordance with Delta’s Privacy Policy, which can be viewed at http://www.delta.com/en_US/privacy-and-security.html.

7. GENERAL CONDITIONS: Released Parties (as defined in Section 8 below) are not responsible for errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the DraftKings Platform, any Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of a Contest, the processing of entries or scanning of tickets, the conducting of a Contest, the announcement of the Prizes, or in any Contest-related materials. Sponsor reserves the right to cancel or modify any Contest if fraud, technical failures or any other factor impairs the integrity of such Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of any Contest or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage or undermine the legitimate operation of a Contest is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserve the right to seek damages and other remedies (including, without limitation, attorneys’ fees and legal costs) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

RELEASE/LIMITS OF LIABILITY:   By entering this Contest, the Contestant agrees to release and hold harmless DK Crown Holdings Inc., Delta Air Lines, Inc.,  each of their respective parents, affiliates, subsidiaries, officers, directors, shareholders, agents, employees and all others associated with the development and execution of any Contest (collectively, “Released Parties”) from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in a Contest, accessing and/or using the DraftKings Platforms, or resulting directly or indirectly, from acceptance, possession, use, or misuse of any Prize awarded in connection with a Contest (including any travel or activity related thereto), including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.

9. DISPUTES: The Contestant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with a Contest, these Official Rules, or any Prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of New York or the appropriate New York State Court located in New York; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a Contest and in no event will Contestant be permitted to obtain attorneys’ fees or other legal costs; and (iii) under no circumstances will Contestant be permitted to obtain awards for and the Contestant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. (Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.) All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Contestant and/or Sponsor in connection with a Contest, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to its choice of law.
